On August 10,1990, Public Law 101-355 104 STAT 416 designated September 21 of each year to be National POW/MIA Recognition Day. In 1996, the observance date was changed to the 3rd Friday in September. This law also recognizes the POW/MIA Flag (at the top of this article) as the official symbol of our Nation's desire to resolve the fates of American Troops unaccounted for in war zones (starting with Southeast Asia). The flag was created by the wife of Navy Lieutenant Commander Michael Hoff who went missing during the Vietnam War when his plane was shot down over Laos. It is black and white to represent the sorrow, anxiety, and hope of the gaunt figure represented on it. Since 1982, this flag has flown just below the US flag at the White House. By 1998, Congress ordered the flag to be displayed on Armed Forces Day, Memorial Day, Flag Day, Independence Day, and Veterans Day.

On September 19, 2025, the President signed 2 Presidential Actions regarding immigration. The first Presidential Action is the EO The Gold Card. Section 1 states that this EO will enable the Secretary of Commerce to facilitate the inclusion of those aliens who have demonstrated their ability and desire to advance the interests of the US by providing a "financial gift" in order to gain entry.
Section 2 orders the Secretaries of Commerce, State, & Homeland Security to establish the Gold Card program IAW 15 USC 1522 which authorizes the Secretary of Commerce to
accept, hold, administer, and utilize gifts and bequests of property, both real and personal, for the purpose of aiding or facilitating the work of the Department of Commerce. Gifts and bequests of money and the proceeds from sales of other property received as gifts or bequests shall be deposited in the Treasury in a separate fund and shall be disbursed upon order of the Secretary of Commerce. Property accepted pursuant to this provision, and the proceeds thereof, shall be used as nearly as possible in accordance with the terms of the gift or bequest. (Pub. L. 88–611, § 1, Oct. 2, 1964, 78 Stat. 991.)
Section 2 sets the gift amount at $1,000,000 for individuals or $2,000,000 for a corporation or similar entity donating on behalf of an individual. Applications shall be reviewed IAW 8 U.S.C. 1153(b)(1)(A), of exceptional business ability and national benefit under 8 U.S.C. 1153(b)(2)(A), and of eligibility for a national-interest waiver under 8 U.S.C. 1153(b)(2)(B). The funds collected under this program shall be used to promote commerce and American industry IAW 15 USC 1512.
Section 3 orders the Secretaries of Commerce, State, and Homeland Security to implement the Gold Card program within 90 days including the limits on the number of visas IAW 8 USC 1151 et seq. establishing process, deadlines, process for businesses, administrative fees, maintenance and transfer fees, and possible expansion to visa applicants IAW 8 U.S.C. 1153(b)(5).
The second Presidential Action is the Proclamation Restriction on Entry of Certain Nonimmigrant Workers. The intro describes the current situation with H-1B visas, showing how the use of these visas has grown (nearly doubling between 2000 and 2019). The Proclamation specifically identifies Information Technology (IT) as an abuser of the H-1B visa system growing from 32% in 2003 to over 65% currently incentivizing the firing of American workers and outsourcing IT jobs to lower-paid foreign workers. It goes on to state that recent IT graduates have some of the highest unemployment rates in the country. In addition, they state abuse of the H-1B visa system is a national security threat, citing evidence of visa fraud, conspiracy to launder money, conspiracy under Racketeer Influenced and Corrupt Organizations Act (RICO), and other illicit activities encouraging foreign workers to come to the US. It also discourages Americans from pursuing careers in science and technology. The Trump Administration has decided that the 'solution' to this growing issue is to impose higher costs for those using the H-1B visa system.
Section 1 restricts entry effective September 21, 2025 for a period of 1 year (at this time; but as we have seen with other 'yearly' Presidential Actions, they can be easily extended with a Presidential Determination). The Secretary of Homeland Security is ordered to restrict entry for those applicants currently outside the US not accompanied by the $100,000 payment for the next 12 months. It also orders the Secretary of State to issue guidance to prevent misuse of the H-1B visa process that have an employment start date prior to October 1, 2026. The Secretary of Homeland Security can identify which H-1B visa workers do not pose a threat to the security or welfare of the US.
Section 2 requires employers to obtain and retain documentation showing that payment has been made prior to filing an H-1B visa on behalf of a foreign worker residing outside the US. The Secretary of State will verify receipt of payment during the visa petition process and approve only those for which the employer has made payment. All necessary and appropriate steps are to be taken to deny entry for any H-1B applicant whose prospective employer has not paid the fee.
Section 3 restricts entry only to aliens who enter or attempt to enter the US starting September 21, 2025. No later than October 21, 2025, the Secretaries of State, Labor, Homeland Security, and the USAG shall report to the President with recommendations on extension or renewals identified in Section 1 are in the best interests of the US.
Section 4 calls upon the Secretary of Labor to initiate rules to revise the prevailing wage levels to be consistent with the policy goals of this Proclamation. The Secretary of Homeland Security is directed to initiate rules to prioritize admission of high-skilled and high-paid foreign workers.
