Section 1 - Purpose - to outlaw the Communist Party, to prohibit members of Communist organizations from serving in certain representative capacities, and for other purposes.
Section 2 - Findings of Fact - The Communist Party constitutes an authoritarian dictatorship within a REPUBLIC, demanding for itself the rights and privileges accorded to political parties, but denying to all others the liberties guaranteed by the Constitution. The Party's policies and programs are secretly prescribed for it by foreign leaders of the world Communist movement. Members are not permitted to voice dissent to party objectives. The Party acknowledges no constitutional or statutory limitations upon its conduct or upon that of its members. The Party advocates the destruction of our Constitutional Republic through any available means including force and violence. The Party is a clear and present continuing danger to the security of the US.
Section 3 - Proscribed Organizations - The Communist Party of the United States, or any successors of such party regardless of the assumed name, whose object or purpose is to overthrow the Government of the United States, or the government of any State, Territory, District, or possession thereof, or the government of any political subdivision therein by force and violence, are not entitled to any of the rights, privileges, and immunities attendant upon legal bodies created under the jurisdiction of the laws of the United States or any political subdivision thereof; and whatever rights, privileges, and immunities which have heretofore been granted to said party or any subsidiary organization by reason of the laws of the United States or any political subdivision thereof, are hereby terminated: Provided, however, That nothing in this section shall be construed as amending the Internal Security Act of 1950, as amended. Section 4 - Members - Whoever knowingly and willfully becomes or remains a member of (1) the Communist Party [by whatever name it is currently called], or (2) any other organization having for one of its purposes or objectives the establishment, control conduct, seizure, or overthrow of the Government of the United States, or the government of any State or political subdivision thereof, by the use of force or violence, with knowledge of the purpose or objective of such organization shall be subject to all the provisions and penalties of the Internal Security Act of 1950, as amended, as a member of a Communist-action organization.
Section 5 - Evidence of Membership - Juries may, under instructions of the court, consider any of the following as evidence of membership in a Communist organization [no matter the name]:
Has been listed to his knowledge as a member in any book or any of the lists, records, correspondence, or any other document of the organization;
Has made financial contribution to the organization in dues, assessments, loans, or in any other form;
Has made himself subject to the discipline of the organization in any form whatsoever;
Has executed orders, plans, or directives of any kind of the organization;
Has acted as an agent, courier, messenger, correspondent, organizer, or in any other capacity in behalf of the organization;
Has conferred with officers or other members of the organization in behalf of any plan or enterprise of the organization;
Has been accepted to his knowledge as an officer or member of the organization or as one to be called upon for services by other officers or members of the organization;
Has written, spoken or in any other way communicated by signal, semaphore, sign, or in any other form of communication orders, directives, or plans of the organization;
Has prepared documents, pamphlets, leaflets, books, or any other type of publication in behalf of the objectives and purposes of the organization;
Has mailed, shipped, circulated, distributed, delivered, or in any other way sent or delivered to others material or propaganda of any kind in behalf of the organization;
Has advised, counseled or in any other way imparted information, suggestions, recommendations to officers or members of the organization or to anyone else in behalf of the objectives of the organization;
Has indicated by word, action, conduct, writing or in any other way a willingness to carry out in any manner and to any degree the plans, designs, objectives, or purposes of the organization;
Has in any other way participated in the activities, planning, actions, objectives, or purposes of the organization;
The enumeration of the above subjects of evidence on membership or participation in the Communist Party or any other organization as above defined, shall not limit the inquiry into and consideration of any other subject of evidence on membership and participation as herein stated.
Amendments added to the Communist Control Act of 1954 (included as sections 6-11):
Section 6 - Subversive Activities Control Act Amendment - adds (E) to hold office or employment with any labor organization, as that term is defined in section 2 (5) of the National Labor Relations Act, as amended (29 U. S. C. 152), or to represent any employer in any matter or proceeding arising or pending under that Act. to Subsection 4(a)(1) of the Subversive Activities Control Act of 1950 (50 USC 784) [64 Stat 992 and 61 Stat 138]
Section 7 - Communist-Infiltrated Organizations - adds to the definition of Communist-Infiltrated Organizations: which (A) is substantially directed, dominated, or controlled by an individual or individuals who are, or who within three years have been actively engaged in, giving aid or support to a Communist- action organization, a Communist foreign government, or the world Communist movement referred to in section 2 of this title, and (B) is serving, or within three years has served, as a means for (i) the giving of aid or support to any such organization, government, or movement, or (ii) the impairment of the military strength of the United States or its industrial capacity to furnish logistical or other material support required by its Armed Forces: Provided, however, That any labor organization which is an affiliate in good standing of a national federation or other labor organization whose policies and activities have been directed to opposing Communist organizations, any Communist foreign government, or the world Communist movement, shall be presumed prima facie not to be a Communist-infiltrated organization. Section 8 - 50 USC 789 § 10 and 50 USC 790 § 11 (a) and (b) are amended - to include Communist-Infiltrated Organization
Section 9 - 50 USC 791 § 12(e) is amended to add upon any application made under subsection (a) or subsection (b) of section 13A of this title, to determine whether any organization is a Communist-infiltrated organization and 50 USC 792 § 13 adds Registration Proceedings before the Board. Section 10 - inserts a new section (13A) Proceedings with Respect to Communist-Infiltrated Organizations setting forth procedures to bring charges under this statute. [62 stat 736, 797, 807; 61 Stat 138; 29 USC 152; 50 USC 782; 29 USC 167; 29 USC 159]
Section 11 - 50 USC 793 § 14 (a) and (b) is amended to show subsection (f)
Section 12 - Separability - if any provision is shown to be invalid, the remainder remains in force.
When President Eisenhower signed this Act into law, he stated that this act contained a substantial portion of his administration's recommendations. He created the Division of Internal Security within the DOJ to pursue enforcement of this Act. He saw this Act as allowing the American people to protect themselves and their institutions against any organization . . . purporting to be a political party . . . [that] is actually a conspiracy dedicated to the violent overthrow of our entire form of government. This Act was the result of needing to fairly prosecute those who would overthrow our Republic while maintaining the judicial procedures of our Republic.
At the time of signing this Act into law, President Eisenhower's administration had convicted 41 Communist leaders, 35 were indicted and awaiting trial, and 105 subversive aliens were deported. These actions were detailed in Recent Developments in Communist Control Act Prosecutions (1964) by Eugene Sidney Bayer. In addition, Bayer's addressed the problem of this act overriding the 1st Amendment right of people to speak freely to protect national security hoping that the judiciary would balance these two opposing issues.
Starting in the 1940s, fears that the current laws were inadequate to fight off the projected Communist takeover of our Republic generated changes to existing laws as well as the culmination of the Communist Control Act described above. To impress upon the American population the perils of Communism, the United States Armed Forces Information Agency created a movie portraying a fictionalized look at life behind the Iron Curtain (USSR) comparing their 'freedoms' to those of an average American family.
Seven years after President Eisenhower signed the Communist Control Act into law President John F Kennedy was still giving speeches on the perils of Communism in our country. The following post is a compilation of two separate speeches where President Kennedy spoke on communism in 1961:
On April 27, 1961, President Kennedy addressed the American Newspaper Publisher's Association during which a reporter asked:
Communism is often described as an ideology or belief that exists somewhere other than in the US. Let me ask you, sir, just how serious a threat to our national security are these communist subversive activities in the US today?
President Kennedy responds:
President Kennedy responded: Well, I think they are serious, I think it's a matter than we should continue to give a great care and attention to. We should support the laws which the US has passed in order to protect us from those who would destroy us from within. We should sustain the Department of Justice (DOJ) in its efforts in the FBI (Federal Bureau of Investigation) and we should be continually alert. I think if the US is maintaining a strong society here in the US, I think that we can meet any internal threat. The major threat is external and will continue.
The clip then segues to another speech President Kennedy gave where he said:
For we are opposed around the world by a monolithic and ruthless conspiracy that relies primarily on covet means for expanding its sphere of influence; on infiltration instead of invasion; on subversion instead of elections; on intimidation instead of free choice on guerillas by night instead of armies by day. It is a system which has conscripted vast human and material resources into the building of a tightly knit, highly efficient machine that combines military, diplomatic, intelligence, economic, scientific, and political operations. It's preparations are concealed, not published. Its mistakes are buried, not headlined. Its dissenters are silenced, not praised. No expenditure is questioned; no rumor is printed; no secret is revealed. It conducts the cold war, in short, with a wartime discipline no democracy would ever hope, or wish, to match. Nevertheless, every democracy recognizes the necessary restraints of national security. And the question remains whether those restraints need to be more strictly observed. If we are to oppose this kind of attack, as well as outright invasion.
Why isn't this Act being used to stop the Socialist/Communist takeover of our government?
Over time, the teeth of this Act were slowly removed:
In 1965, SCOTUS abolished the registration requirement was abolished because SCOTUS found it violated the 5th Amendment right against self-incrimination.
In 1967, US v Robel struck down the portion of the Act that prohibited Communists from working in the US Government as being a violation of 1st Amendment Rights.
In 1971, when President Nixon signed the Non-Detention Act of 1971 into law, the emergency detention of suspected Communists was repealed.
In 1972, the Subversive Activities Control Board was abolished.
Because the courts struck down various parts of the Communist Control Act:
We now have avowed Communists using their 1st Amendment Right to call for the US Government to be overthrown, subverted, and/or replaced.
We now have avowed Communists working from within the US Government. I'm thinking they are the ones we refer to as "deep state" actors.
We now have courts filled with foreign-born activist judges siding with the people who want to overthrow our government.
We now have a "Democratic Socialist of America" party (which is actually a Communist organization) emerging from their hiding place within the Democrat Party and taking over the original Democrat Party; however, the 'mainstream' members of the party do not realize that their party has been hijacked.
And worst of all, the "new" Democratic Party aka Democratic Socialists of America Party aka Communist Party, has announced their goal to overthrow the US Constitution. Our Constitution and Bill of Rights are being used to dismantle our government and it started with those 30, 40, & 50 year (s)elected members of our Congress and Judicial System who have systematically removed barriers to subversion by foreigners (including those people born on US soil whose parents are both foreigners who raise these US-born children under the foreigners' home country rules). You'd think now that the Socialist/Communists have announced they want to take over our government, that our government would be able to do something about it! But looking at this piece of legislation that was written to be able to find and remove Socialist/Communists from our country has had its teeth removed.
